Deportation proceedings begin when the government orders a person to appear in Immigration Court and defend himself against removal or deportation. Removal or deportation cases can arise for a number of reasons, including:
- Commission or conviction of a criminal offense
- Overstaying a visa
- Failure to maintain non-immigrant status
- Termination of conditional residency
- Illegal entry
- Abandonment of permanent residency
Deportation and removal cases require careful analysis at the outset to determine appropriate courses of action. Many times, there is no defense to the charges lodged against the immigrant. The immigrant and his family must then explore, with their lawyer, whether forms of relief are available. Such forms include asylum, withholding of removal, relief under the Convention Against Torture, cancellation of removal, adjustment of status, waivers under applicable sections of law, and even U.S. citizenship. As noted earlier, the immigration lawyer may need to return to criminal court to see whether an old conviction can now be vacated.
